84th Recap: Regulation of Construction Contractors
Another bill of great concern to TMHA this session was HB 3148 with the caption of: "Relating to the regulation of construction contractors." As filed this would have required any person who built, improved, repaired, renovated, conducted maintenance, remodeled, demolished, drilled, or excavated real property to register with the Texas Department of Licensing and Regulation and would also be subject to the department's regulation and enforcement provisions. The bill as filed was exceptionally broad and was read to cast such a wide net and without any exclusions for those licenses and occupations that are already licensed under other provisions, such as manufacturers, retailers and installers of manufactured homes that it would have required duel licensing and added another layer of agency enforcement on our industry (along with many other industries we might add).
Fortunately, HB 3148 made it only to bill filing and no further. HB 3148 was never heard in committee and thus never moved this session.
